Advance Directive Form

Idaho’s Advance Directive form specifies an individual’s instructions regarding their health care and treatment and authorizes a healthcare proxy. It contains both the living and last will. This form must be signed by the individual, proxy, and a witness.

How to Order a Death Certificate

In Idaho, only the deceased’s immediate family members and their legal representatives can request a death certificate. Step-relatives, uncles and aunts, cousins, grandchildren, and grandparents aren’t immediate family members. People who show a proven interest in purchasing the deceased’s property may also obtain a certificate.

The information required for obtaining the certificate includes:

  • Deceased’s legal name
  • Date and place of death
  • Applicant’s name
  • Applicant’s phone number and address
  • Purpose for request
  • Applicant’s relation to the deceased and its proof
  • Copy of applicant’s government-issued photo ID

A certificate costs $14. Each additional copy is priced at $14 if ordered at the same time and $19 if ordered separately. Rush orders come with an additional $5 fee.

Digital Estate Planning Law

The Idaho SB1303 Revised Uniform Fiduciary Access to Digital Assets Act authorizes an individual’s legal representative who can access and control their digital assets and communications. This bill came into effect on July 1, 2016.
